ProNews.ca Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the ProNews.ca website (the “Service”) operated by ProNews.ca (“us,” “we,” or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2.1 Our Content

The Service and its original content, features, and functionality are and will remain the exclusive property of ProNews.ca and its licensors. The content, including but not limited to articles, photographs, and videos, is protected by copyright, trademark, and other laws of both Canada and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ProNews.ca.

2.2 Limited License to Users

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as generally and expressly permitted by the Service.

3. User Conduct and Content (Comments)

3.1 Acceptable Use

You agree not to use the Service in any way that violates any applicable Canadian, provincial, local, or international law or regulation.

3.2 User Comments and Submissions

The Service may contain message boards, chat functions, and other interactive features that allow users to post, submit, publish, display, or transmit content or materials (collectively, “User Content”).

  • Responsibility: You are solely responsible for your User Content. By posting User Content, you grant ProNews.ca a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute your User Content in any media.
  • Prohibited Content: You agree not to post User Content that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, inflammatory, hateful, libelous, or otherwise objectionable, or that violates the legal rights (including the rights of publicity and privacy) of others.
  • Monitoring and Enforcement: We reserve the right, but not the obligation, to review, edit, or remove any User Content, and to terminate your access to the Service for any violation of these Terms.

4. Disclaimers and Limitation of Liability

4.1 Information Purposes Only

The content on ProNews.ca is provided for general informational purposes only. While we strive for accuracy, we do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk.

4.2 Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

4.3 Limitation of Liability

In no event shall ProNews.ca, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

5. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Alberta to resolve any legal matter arising from the Terms.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
